Terms of Service

1. Acceptance of Terms

By accessing or using ThinkFlow AI, a product of AppOrigin Inc. (the "Service") at thinkflowai.us, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. These Terms constitute a legally binding agreement between you and AppOrigin Inc.. We reserve the right to update these Terms at any time, and your continued use of the Service constitutes acceptance of any changes.

2. Description of Service

ThinkFlow AI is an AI-powered UI design platform that allows users to generate web and mobile application designs from natural language prompts. The Service includes the AI Studio, project management tools, template library, export functionality, and all related features accessible through your account. The Service is provided on an "as is" and "as available" basis.

3. Account Registration

To access certain features of the Service, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Keep your login credentials confidential and not share them with any third party
• Notify us immediately at [email protected] of any unauthorized use of your account
• Accept responsibility for all activities that occur under your account

We reserve the right to terminate accounts that violate these Terms or that have been inactive for more than 12 consecutive months.

4. Subscription Plans and Credits

ThinkFlow AI offers the following service tiers:

Free Plan: Limited to 10 AI generations per month. Access to basic templates and standard export formats.

Pro Plan ($29/month): 200 AI generations per month, access to all device frames, premium templates, priority generation, and all export formats including React Native.

Enterprise Plan ($99/month): Unlimited AI generations, dedicated support, custom templates, team collaboration features, and white-label options.

Credits: Additional generation credits may be purchased at any time. Credits do not expire and roll over month to month. Subscription plan credits reset at the start of each billing cycle and do not roll over.

5. Payment and Billing

All payments are processed securely by Stripe, Inc. By providing payment information, you authorize ThinkFlow AI to charge your payment method for the applicable fees.

• Subscription fees are billed in advance on a monthly basis.
• All fees are non-refundable except as required by law.
• We reserve the right to change pricing with 30 days' advance notice via email.
• Failure to pay may result in suspension or termination of your account.
• You are responsible for all applicable taxes.

6. Intellectual Property

Your Content: You retain ownership of all prompts, designs, and content you create using the Service ("User Content"). By using the Service, you grant ThinkFlow AI a limited, non-exclusive license to process your User Content solely to provide the Service to you.

Generated Designs: You own the designs generated through the Service and may use them for any commercial or non-commercial purpose, subject to these Terms.

ThinkFlow AI IP: The Service, including its software, design, trademarks, and all related intellectual property, is owned exclusively by ThinkFlow AI. You may not copy, modify, distribute, sell, or lease any part of the Service without our express written permission.

Feedback: Any feedback, suggestions, or ideas you provide to us may be used by ThinkFlow AI without restriction or compensation to you.

7. Acceptable Use

You agree not to use the Service to:

• Generate content that is illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable
• Infringe any third party's intellectual property, privacy, or other rights
• Generate content that violates any applicable laws or regulations
• Attempt to reverse engineer, decompile, or extract the source code of the Service
• Use automated tools, bots, or scrapers to access the Service without our written permission
• Circumvent any usage limits, access controls, or security measures
• Resell or sublicense access to the Service without our express written consent
• Use the Service to train competing AI models

Violation of these restrictions may result in immediate account termination without refund.

8. Privacy

Your use of the Service is also governed by our Privacy Policy, available at thinkflowai.us/privacy, which is incorporated into these Terms by reference. By using the Service, you consent to the collection and use of your information as described in the Privacy Policy.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

ThinkFlow AI does not warrant that the Service will be uninterrupted, timely, secure, or error-free, or that the results obtained from use of the Service will be accurate or reliable. AI-generated designs are provided for reference and may require professional review before use in production environments.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THINKFLOW AI AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR ACCESS TO OR USE OF (OR INABILITY TO ACCESS OR USE) THE SERVICE.

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM OR (B) $100 USD.

11. Indemnification

You agree to indemnify, defend, and hold harmless ThinkFlow AI and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with your access to or use of the Service, your violation of these Terms, or your violation of any rights of another person or entity.

12. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice. Upon termination, your right to use the Service will immediately cease. We may delete your account data after 30 days, except where retention is required by law.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of New Jersey, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in New Jersey, and you consent to personal jurisdiction in such courts.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by updating the "Last Updated" date and, where appropriate, sending an email notification. Your continued use of the Service after changes take effect constitutes your acceptance of the revised Terms.
